Terms of Service

Pixinity AI is an AI-powered image generation and editing platform that allows you to:

• Generate images from text prompts using multiple AI quality tiers (Fast, Standard, High Quality, Premium)
• Edit and transform existing images using AI-powered tools
• Upload reference images to guide AI generation
• Download and use generated images for personal or commercial purposes

The Service operates on a credit-based system where you purchase credits to generate or edit images. Different quality tiers consume different amounts of credits.

3.1. Registration: You must create an account using Google Sign-In to use the Service. We use Google's secure authentication system.

3.2. Age Requirement: You must be at least 18 years old to use the Service. By using Pixinity AI, you confirm that you meet this age requirement.

3.3. Account Security: You are responsible for maintaining the security of your account and all activities that occur under it. Do not share your account with others.

3.4. Account Information: You agree to provide accurate information and keep it updated. We may suspend accounts with false or misleading information.

4.1. Credit System: The Service uses a credit-based model. You purchase credit packs to generate or edit images.

• Starter Plan: $9.99 for 100 credits
• Pro Plan: $19.99 for 200 credits
• Premium Plan: $29.99 for 300 credits

4.2. Credit Consumption: Different quality tiers consume different credits per image:

• Premium tier: 4 credits per image
• High Quality tier: 2 credits per image
• Standard tier: 2 credits per image
• Fast tier: 1 credit per image

4.3. No Expiration: Purchased credits do not expire and remain in your account indefinitely.

4.4. Refund Policy: All credit purchases are final and non-refundable. We recommend starting with the Starter plan ($9.99) to test the Service before making larger purchases. Exceptions may be made for technical issues that prevent service delivery, evaluated on a case-by-case basis.

4.5. Payment Processing: All payments are processed securely through DodoPayments. We do not store your payment card information.

4.6. Price Changes: We reserve the right to modify pricing with 30 days notice. Existing credits remain valid at their original value.

You agree NOT to use the Service to create:

• Illegal Content: Any content that violates local, state, national, or international laws
• Child Exploitation: Any imagery depicting minors in inappropriate, sexual, or exploitative situations (zero tolerance - immediate account termination and reporting to authorities)
• Non-Consensual Imagery: Realistic images of real people without their consent, including deepfakes, revenge imagery, or defamatory content
• Violence & Hate: Content promoting violence, terrorism, self-harm, or discrimination based on race, ethnicity, religion, gender, or sexual orientation
• Misinformation: Deliberately misleading content designed to deceive, including fake news imagery or fraudulent documents
• Intellectual Property Violations: Content that infringes on copyrights, trademarks, or other intellectual property rights
• Spam & Abuse: Automated mass generation, system abuse, or any attempt to exploit vulnerabilities

Enforcement: Violations may result in immediate account suspension or termination without refund. Severe violations will be reported to appropriate authorities.

6.1. Your Ownership: Subject to your compliance with these Terms, you own the images you generate using Pixinity AI. You receive full commercial rights to use, sell, license, or distribute your generated images.

6.2. Reference Images: When you upload reference images for editing or guidance, you confirm that you have the right to use those images. We are not responsible for any copyright claims arising from your uploaded content.

6.3. Platform License: You grant Pixinity AI a limited license to store, process, and display your images solely for providing the Service. We will not publicly share your images without permission.

6.4. AI Training: We may use anonymized, aggregated data (not your specific images) to improve our service quality and content moderation systems.

6.5. Your Responsibility: You are solely responsible for ensuring your use of generated images complies with applicable laws and does not infringe on third-party rights.

6.6. Platform Rights: The Pixinity AI platform, including its software, design, branding, and user interface, is our intellectual property and protected by copyright and trademark laws.

7.1. No Guarantees: AI-generated images may not always match your expectations. Results vary based on prompts, selected quality tier, and AI model capabilities.

7.2. Potential Issues: Generated images may occasionally contain artifacts, inconsistencies, or unintended elements. Credits are consumed upon generation regardless of satisfaction with results.

7.3. Not Professional Advice: Generated images should not be relied upon for medical, legal, financial, or other professional purposes.

8.1. Uptime: We strive for high availability but do not guarantee uninterrupted service. Occasional downtime for maintenance or updates may occur.

8.2. Third-Party Dependencies: Our Service relies on third-party AI providers. Service quality and availability may be affected by factors outside our control.

8.3. Service Changes: We may modify, suspend, or discontinue features with reasonable notice. We will make reasonable efforts to notify users of significant changes.

11.1. By You: You may delete your account at any time. Unused credits will be forfeited upon deletion.

11.2. By Us: We may suspend or terminate your account immediately if you violate these Terms, particularly the Acceptable Use Policy. No refunds will be provided for termination due to violations.

11.3. Effect of Termination: Upon termination, your right to use the Service ends immediately. We may delete your account data, including generated images, within 90 days.

13.1. Governing Law: These Terms are governed by the laws of India, without regard to conflict of law principles.

13.2. Dispute Resolution: Any disputes arising from these Terms or your use of the Service shall be resolved through good-faith negotiation first. If unresolved, disputes shall be subject to the exclusive jurisdiction of courts in India.

14.1. Entire Agreement: These Terms constitute the entire agreement between you and Pixinity AI regarding the Service.

14.2. Severability: If any provision is found unenforceable, the remaining provisions remain in effect.

14.3. No Waiver: Our failure to enforce any right or provision does not constitute a waiver of that right.

14.4. Assignment: You may not assign your rights under these Terms without our consent. We may assign our rights freely.
